The Windows & Doors are warranted by Coastal Industries, Inc., for a period of twenty years as to the material extrusions (structural parts) and five years as to the mechanical components of the basic window unit, under normal use and service, subject to the terms and conditions contained in this warranty certificate.
That Coastal Industries’ double glazed insulating glass units are warranted for a period of ten years from date of invoice to be free from and will not develop material obstruction of vision as a result of dust, film formation or any other matter between the interior glass surfaces, caused by failure of the Hermetic Seal.
Any claims for defects under this warranty should be submitted in writing to the Dealer referenced below. If you are not satisfied with the Dealer or purchased directly from Coastal you must submit in writing to Coastal Industries promptly after discovery, describing the defect claimed and referring to this certificate series and date of issuance, together with proof of purchase. Allow a reasonable time for inspection purposes. If after inspection by Coastal Industries it is determined that the claim is valid in accordance with the provisions of this warranty, Coastal Industries agrees at its option to repair or replace any defective part or component without charge which shall be shipped to Coastal Industries; transportation charges prepaid and returned F.O.B. to Coastal Industries.
The original warranty period shall not be extended by any such repair or replacement, but the remaining warranty time period shall continue in effect and be applicable under the terms and conditions of this warranty to the repaired or replaced part or component of the window.
Coastal Industries reserves the right to discontinue or change any Coastal Industries Window as manufactured. If the part of component of the window originally installed is not available and Coastal Industries determines to make replacement, Coastal Industries shall have the right to substitute such part or component designated by Coastal Industries to be of equal quality and price.
This warranty only covers manufacturing defects as specified herein and does not include defects or damages attributable to Installation by others, normal weathering or defects or damages caused by; accidents or fire, flood, or other Acts of God, or by vandalism, not or civil disorder, misuse abuse or harmful fumes, vapors or chemical pollutants in the atmosphere, mildew, building settlement or structural failures of walls or foundations, or if subjected to stresses resulting from localized heat which causes excessive temperature differentials over the glass surfaces or edges, or any other causes or occurrences beyond Coastal Industries control, Condensation on windows which may occur as the natural result of humidity within the house or building area, and interior/exterior temperature differential does not indicate a defect in the window and would not be included in this warranty. This warranty is valid only if genuine Coastal Industries Windows are used, but shall be void if window accessory products not manufactured by Coastal Industries, Inc. are installed which cause defects to occur in the windows.
This warranty shall be for the benefit of the original Property Owner only and is limited to material costs of repair or replacement for defective part or component as provided and does not include broken glass or torn screening. ALL WARRANTIES IMPLIED BY LAW, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY AND FITNESS FOR PARTICULAR PURPOSE, ON THE PRODUCTS COVERED BY THIS WARRANTY SHALL BE EFFECTIVE ONLY FOR THE APPLICABLE PERIODS OF TIME SET FORTH IN THIS WARRANTY. THE REMEDY UNDER THIS WARRANTY OR ANY OTHER WARRANTY, EXPRESS OR IMPLIED, INCLUDING ALL WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, IS LIMITED SOLEY AND EXCLUSIVELY TO FURNINSHING A REPLACEMENT PART OR PARTS AS SET FORTH IN THIS WARRANTY. UNDER NO CIRCUMSTANCES WILL COASTAL INDUSTRIES, INC. BE LIABLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGE TO OR LOSS OF OTHER PROPERTY OR EQUIPMENT, OR FOR THE COST OF REMOVING, INSTALLING OR REINSTALLING ANY REPLACEMENT PART OF PARTS FURNISHED HEREUNDER, SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, AND SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF REMEDIES FOR BREACH OF WARRANTY, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE.
